Trustees have no fiduciary duty to predecessors

From www.khq.com.au: The High Court ruled in Naaman v Jaken Properties Australia Pty Limited that a successor trustee does not owe a fiduciary duty to a former trustee regarding the latter’s entitlement to indemnification from trust assets.

The relationship between former and successor trustees is governed by equitable proprietary rights rather than fiduciary obligations.
