From asic.gov.au: The Full Federal Court of Australia unanimously found in favor of ASIC in two appeals concerning small amount lender Sunshine Loans, dismissing the lender’s appeal against a prior decision that it had charged unlawful fees to customers.

ASIC successfully appealed a separate recusal decision regarding the penalty hearing, with the court providing that the penalty should consider insights from the initial hearing.

The case will return to Justice Derrington for a determination on the appropriate penalty that Sunshine Loans must pay for its misconduct.
