From www.accountantsdaily.com.au: The Commissioner of Taxation has filed an appeal in the Federal Court against a recent Administrative Review Tribunal decision that allowed a truck driver to claim $32,782.50 in meal expense deductions for the 2021 income year.

The ATO had initially reduced the driver’s claim to zero but later partially accepted it, allowing $5,890 based on his logbook and other evidence.

The tribunal criticised the ATO’s allowance of only $19 per day for meals as “absurdly inadequate” and concluded that the truck driver had incurred the disputed expenses while earning assessable income.
