From sladen.com.au: The Federal Court ruled that a term in PayPal’s standard contracts with small businesses, allowing it to retain erroneously charged fees unless reported within 60 days, was unfair and void under the Competition and Consumer Act 2010.
The court noted that this term created a significant imbalance in the parties’ rights and did not protect the legitimate interests of PayPal, while also lacking transparency despite being legible in the contract.
Following the ruling, PayPal agreed to remove the unfair term from its contracts.
