ASIC v Noumi: privilege preserved

by

Ed.

From hallandwilcox.com.au: The Full Court of the Federal Court overturned a previous ruling that Noumi Limited waived legal professional privilege over a report it provided to ASIC, affirming the effectiveness of ASIC’s voluntary disclosure regime.

The court determined that Noumi maintained confidentiality over the report submitted under a voluntary disclosure agreement which prevents waiver of privilege.
