ACCC merger clearance reforms transition

From www.claytonutz.com: Starting January 1, 2026, merger parties that meet specific thresholds must notify the ACCC and obtain clearance before completing transactions, or face penalties.

The ACCC has outlined a transition period leading up to this new regime, with key deadlines for seeking informal clearance and updated guidance for existing deals.

Transactions that do not meet the new thresholds will still be subject to competition laws, allowing the ACCC to investigate any that may substantially lessen competition.
